Mens Rea
The defendant must have the mens rea for the crime. Condition intent allows for the defendant to be charged if they would have stolen if there was something there.
Mens Rea for Murder
Intention to kill must be proven, GBH is not sufficient. R v Whybrow
Recklessness
Isn't sufficient for attempt. R v Millard and Vernon
Impossibility
A person may be guilty of attempting to commit an offence even though the facts are such that the commission of the offence is impossible. R v Shivpuri
