  • what happens when the claimant recieves the defense?
    When the claimant recieves the defense, the court will send out an allocation questionnaire to all the parties involved in the case.
  • What is the purpose of an allocation questionnaire?
    To gather information about the parties involved in a legal dispute and their respective claims, in order to assist the court in managing the case. An allocation fee is payable (£ 100 ) which may encourage parties to negotiate an out of court settlement at this stage.
  • Who monitors the case?
    The court monitors the case; judges are supported by court staff to keep records of documents such as the allocation questionnaire and to make sure deadlines have been met.
  • What happens when the allocation questionnaire ha been completed?
    A procedural judge will allocate the case to a track. A date will then be set, at least 21 days later.
