  when an offender is found guilty in court and spends time in prison or another institution such as a young offender's institution or a high -Security psychiatric hospital. There are several aims of ustudial sentining

  • Deterrence
  • Incapacitation
  • Retribution
  • Rehabilitation
• Outline Deterrence as an aim of Custodial sentencing

  Custodial sentering aims to deter (discowage) offending behaviour through:

  • Punishment- individuals will being less likely to reoffend because they were previously punished (prison) for it.
  • Vicarious reinforcement-individuals will be less likely to imitate offending behaviour if they observe offenders being parished (prison) for their behaviour
• Outline incapacitation as an aim of Custodial sentencing


  Cs aims to incapacitate individuals from reoffending

  As it removes offenders from society and so, at least for the duration of their custodial sentence, they can't offend. also not viewed as a threat to society
• Outline Retribution as an aim of Custodial sentencing


  CS aims to act as a form of Retribution for the victim's friends and family as well as society more generally.

  the offendershould pay for their offending behaviour in some way. Cs thus inolive s taking away the offender's freedom as a form of retribution
• Outline Rehabilitation as an aim of Custodial sentencing


  CS ails to provide an opportunity to rehabilitate offenders so they are less likely to reoffend. (E.g. Anger Mangement). Thus offenders will be in a better position to lead a crime-free life once released.
