  • What is the Law Commission?
    ---> set up by Law Commission Act 1965 and main aim is to keep all law under review

    Independent from government and consists of:
    5 fulltime Law Commissioners
    • Chairperson (High Court Judge of Appeal) appointed for 3 years
    • 4 Commissioners who are judges, barristers, solicitors or academics
    Supported by:
    • Chief Executive & 20 members of Government Legal Service
    • 2 Parliamentary Counsel - draft laws
    • Research assistants
  • Their work involves;
    • Receiving and considering proposals for law reform and consulting parties
    • Suggest proposals for reform which Codify, Consolidate and Repeal law

  • Codify, Consolidate and Repeal
    Codify-
    • Brings all existing law into one Act of Parliament. Combines existing Acts of Parliament & common law from courts
    • e.g. Draft Criminal Code 1985 (all criminal law brought together)
    Consolidate-
    • Brings all existing law into one Act of Parliament, only combines existing Acts of Parliament
    • e.g. Sentencing Act 2020
    Repeal-
    • Identifies old laws which aren't needed and recommends these to be removed
    • e.g. Statute Law (Repeals) Act 1998 - 150 outdated laws removed
