Robbery

• robbery is theft with use or threat or force
• s8 of Theft Act 1968- 'a person is guilty of robbery if he steals and immediately before or at the time of doing so, and in order to do so, he uses force on any person or puts any person in fear of being subjected to force.'

  • intended to use force to steal
• must be a completed theft for a robbery to have been committed so all elements of theft have to be present. - R V Zerei

• victim doesn't have to be frightened - B and R V DPP
• force immediately before or at the time of the theft - R V Hale
• mens rea must be the mens rea for theft but also intention to use force to steal.
