Magistrates to the High corut

• Who can appeal to the High court?

  Prosecution or defence

  Magistrates made a wrong decision because of a mistake in the law
• What can the high court do?

  • Reverse the decision
  • Give an alternative
• What happens if the case is successful?

  The case is sent back to the magistrates for reconsideration.
• Who hears the appeal?

  2-3 high court judges
• Where can a further appeal be made to?

  Court of appeal (criminal division) then supreme court
• When can a case be appealed higher than the high court?

  There is a point of public importance

  OR

  Leave to appeal is granted by the KBD or the Crown court

  Then to go to the supreme court leave is granted by the court of appeal
