  • What sets out the aims of sentencing?
    S.57 of the Sentencing Act 2020
  • What are the 5 Aims of sentencing for adults?
    1.Punishment
    2. Reduction of crime
    3. Reform and rehabilitation
    4. Protection of the public
    5. Reparation by offenders to the victim
  • Describe how Punishment/ Retribution is an aim of sentencing?
    The sentence should fit the crime and there should be an element of blame taken by the offender.
    • Based on the idea that each offence should have a certain tariff or level of sentencing set by the sentencing council.
    • The judge decides the category of offence based on factors and the level of blame and then set an appropriate sentence.
    • E.G. Imprisonment, fines, Community orders
  • Describe how Deterrence is an aim of sentencing?
    Aim is to punish to put D off from reoffending due to the fear of punishment or prevent potential offenders from offending.
    The TWO types are:
    • Individual deterrence and General deterrence
    For example, Anti-social crimes of 2024 riots - however it isn't very effective as around 55%of adult prisoners reoffend within 2 years.
  • Describe how Reform/Rehabilitation is an aim of sentencing?
    Aim is to reform and reduce the chance of reoffenders.
    It is to try and alter their behavior.
    PART 9 of the sentencing act 2020 provides for community orders to be made with requirements attached, which is meant to help in rehabilitating the offender.
    For example, carehome work.
  • Describe how Protection of society is an aim of sentencing?
    Taking them out of prison by them serving a prison sentence so they're unable to commit further offences.
    E.G. enforcing a ban like the disqualifications from driving.
  • Describe how Reparation is an aim of sentencing?
    Offender paying compensation to the victim .
    Sometimes offenders are required to carry out unpaid work in the community - can be seen as reparation to the whole of society.
    Another example is Restorative justice - where D ad the V meet to talk of their experience and try to make some amend - mainly in burglary cases.
