  • the defendant may be represented by duty solicitor free of charge for one hearing
  • if the defendant pleads guilty the magistrates will pass sentence
  • if the defendant pleads not guilty, his trial will be heard and decided by the magistrates
  • during a trial both sides give evidence and burden of proof and prosecution to prove defendants guilt beyond reasonable doubt
