  • The law shall take effect fifteen (15) days following its complete publication in the Official Gazette or in at least two (2) newspapers of general circulation.
  • A person who has been removed from his/her position or who has been dismissed from the service for cause shall not be appointed to any public office within one year after dismissal.
  • No person who has been convicted by final judgment of an offense involving moral turpitude, dishonesty, fraud, malversation, misappropriation, embezzlement, or any other crime under the Revised Penal Code as amended, or under special laws relating to corrupt practices, shall be qualified to hold public office unless he/she is expressly exempted from disqualification by this Constitution or by law.
  • Any violation of Section 46 hereof shall constitute grounds for revocation of accreditation.
  • No person, whether natural or juridical, public officer, government official, employee, or any other individual, shall be allowed to use his/her position to influence the decision of another person regarding the granting of an accreditation certificate under this Act.
  • Any person who holds public office during the period of disqualification provided herein shall not be eligible for reappointment to such position nor for appointment to another public office immediately thereafter.

  • No appointment, promotion, transfer, reemployment, or reinstatement to any public office shall be valid if made contrary to this section.
  • Any officer or employee found guilty of violating this provision shall suffer the penalty of dismissal from service with perpetual disqualification from holding any public office.
  • All appointments, promotions, transfers, reemployments, and reinstatements made by an official or employee prohibited under Section 46 are considered null and void.
  • Any officer or employee found guilty of grave abuse of authority or gross neglect of duty shall suffer suspension without pay for more than three months but not exceeding six months upon recommendation of the head of department concerned and approval of the President.
  • If the act constituting the grave abuse of authority or gross neglect of duty was committed with evident bad faith or willful intent to violate the law or perpetrate serious misconduct, the penalty of dismissal from the service shall be imposed upon such officer or employee.
  • In case of temporary vacancies in offices mentioned herein, the appointing power may designate an acting officer.
  • All existing laws, rules, and regulations inconsistent with this Act are hereby repealed or modified accordingly.
  • This Act shall take effect upon its approval.
  • Section 1. The State recognizes the vital role of non-government organizations (NGOs), people's organizations (POs), and similar institutions in nation building and poverty reduction efforts.
  • All existing rules and regulations governing the issuance of accreditations are hereby repealed or modified accordingly.
  • In case of conflict between this Act and any provision of Presidential Decree No. 1894, Executive Order No. 292, Administrative Order No. 1, Memorandum Circular No. 1-98, and all other related issuances, this Act shall prevail.
  • All appointments made contrary to the provisions of this section are void ab initio.
  • If the appointee fails to submit the required documents or information within thirty (30) calendar days from receipt of notice requiring their submission, the Commission on Appointments shall declare the nomination invalid.
  • The Commission on Appointments (CA) shall have the power to review all appointments made by the President within thirty days from receipt of notice of such appointments.
  • If the CA finds that the appointee does not meet the qualifications required by law, it may recommend to Congress the removal of the appointee.
  • In case of failure of the CA to act upon the recommendation within sixty days from its submission, the appointee shall continue to serve until removed by the President.
  • The Commission on Audit (COA) is authorized to conduct periodic audit of all records, accounts, documents, vouchers, and papers pertaining to the operations of the CSOs covered by this Act.
  • All books of account, journals, ledgers, receipts, vouchers, and other accounting and financial records of the CSOs shall be preserved for at least five (5) years from the date of filing of the annual report required under this Act.
  • The Commission on Appointments (CA) is responsible for confirming all presidential appointees except those exempted by law.
  • The CA consists of nine members appointed by the President, including three Senators, three Representatives, one Justice of the Supreme Court, and two citizens from private life.
  • The Commission on Audit (COA) is authorized to conduct investigations into all matters relating to the administration of government funds, properties, transactions, and activities covered by this Act.
  • The Senate President serves as the Chairman of the CA, while the Speaker of the House acts as Vice Chairperson.
  • Investigations may include audits, inspections, hearings, and inquiries.
  • The COA can summon witnesses and require them to produce documents relevant to its investigation.
  • The COA can summon persons to appear and testify at its proceedings and compel their attendance through subpoena duces tecum.
  • The Commission on Appointments (CA) is composed of nine members who serve as ex officio members representing their respective houses of Congress.
  • Members of the CA include the Senate President, Speaker of the House of Representatives, Majority Leader of the Senate, Minority Leader of the Senate, Majority Leader of the House of Representatives, and Minority Leader of the House of Representatives.
  • The Commission on Audit is authorized to promulgate the necessary implementing rules and regulations within thirty (30) days from the effectivity of this Act.
  • No person who has been removed from his position as provided in this Act shall be eligible for appointment to any other position in the government service during the term of his removal.
  • The COA has the right to examine any books, documents, papers, records, vouchers, receipts, contracts, agreements, and other transactions of GOCCs.
  • People’s Organizations (POs) refer to associations, federations, confederation, councils, networks, coalitions, and other formations of individuals organized around common interests, identities, needs, aspirations, concerns, issues, problems, advocacies, causes, and objectives.
  • Non-Government Organizations (NGOs) refer to any organization that is established as a juridical entity under Philippine Law, whether domestic or foreign, which has no stockholders, profit motive, or commercial purpose, and whose main objective is to promote social welfare, culture, education, health, environment protection, alleviation of poverty, human rights, justice, peace, and other related purposes.
  • The State encourages their active participation in all aspects of national development through partnership with government agencies at all levels.
