  • Aims of sentencing is punishment. D deserves punishment for his acts and this is based on an eye for an eye society and victims getting revenge. The judge/magistrates ensure that the sentence is given in proportion to that offence e.g. mandatory life custodial sentence for murder.
  • Another aim of sentencing is public protection. It is to prevent the offender from harming the public.
    Where the court considers that there is a significant risk to members of the public of serious harm being caused by the offender in the future, the court must impose a custodial sentence
    Home detention curfew orders can be imposed on the D ordering him to stay home at certain times (monitored)
  • Another aim for sentencing is rehabilitation. To reform the offender and try to ‘cure’ his criminal behaviour in order to rehabilitate him into society
    It is a forward-looking aim with the hope that the offender’s behaviour will be altered by the penalty imposed e.g. community order with a condition to attend alcohol treatment programme.
  • Reparation. So to make amends to the victim of the crime 
    E.g. paying compensation or ordering ‘restitution’ which means returning the stolen property.
    Reparation projects - brings the defendant and victim together so D can make direct reparation to V.
  • Court uses sentencing to try and lower the levels of crime in the future.
    Individual deterrence - punishing the offender so that they are less likely to reoffend.
    General deterrence - making an example of an offender in order to warn other potential offenders.
