  • Key principle
    The offence of which a person is convicted must correctly describe the crime that has been committed
  • Why?
    There is a moral stigma attached to a criminal conviction so it is important that the crime should carry the correct 'label' (eg unfair to label a person convicted with involuntary ms as a murderer)
  • Non-fatals
    Clear labelling:
    • S47 OAPA = assault occasionally in ABH
    • S20 OAPA = Inflicting GBH
