Loss of control

• Loss of control is set out in the coroners and justice act of 2009
• Loss of control is a partial defence to murder
• Three tests must be satisfied
• Test 1, there must be loss of control s54(2)
• Loss of control must be total
• loss of control does not have to be sudden
• A concidered desire for revenge will not be loss of control as in Jewell
