  ->false statement of a material fact made by a party ot the contract which induces the party into the contract

  ->made by one party to the agreement, to the other party, at or before the time of agreement

  -> can make a contract void

  -> remains valid until the person who suffers the misrepresentation choose to rescind the contract

  ->must not be intended to form part of contract, if intended to form contract then it's a legally binding term, not a representation
