• The rules on the defence of Insanity are based on the M'Naghten rules
• According to the case of M'Naughten, the three elements that must be proven are:

  1. The defendant suffered from a defect of reason
  2. The defect of reason arose from a disease of the mind
  3. The defect of reason caused the defendant not to know the nature and quality of their act, or not know they were doing wrong.
