  • Types of delegated legislation:
    -       Orders in council

  • Orders in council
    Made by the King on the advice of the Privy council.
    • Used for matters where it wouldn’t be wise to take up parliamentary time with or emergency situations 
  • Privy council – made up of the Prime Minister and other leading members of parliament 
  • Statutory instruments 
    Made by a government minister under the authority of a Parent Act.
    • Often used to update laws (e.g. increase to minimum wage) but can be longer with regulations that were too complex to include in an act of parliament (e.g. police codes of practice)
  • Byelaws 
    Made by local authorities for their geographical area and enforced by Mag’s court.
    • E.g. banning drinking in public, parking restrictions 
    Can also be made by public corporations and companies (e.g. Boddington v British Transport Police – smoking on a train)
