  • Which courts mainly deal with criminal cases?
    Magistrates and Crown Courts
  • How is a criminal case brought forward?
    By the Crown Prosecution Service and they decide whether a case is brought on behalf of the state
  • Decision
    Th defendant is convicted if guilty or acquitted if not guilty. The decision is made by a jury or magistrate
  • Level of proof required
    Beyond reasonable doubt
  • Burden of proof
    Innocent until proven guilty, the prosecution must prove their case, the accused does not have to prove their innocence
  • Sanctions
    Non-custodial or custodial sentences given if found guilty
  • Appeal
    The defendant may appeal a court's verdict in regard to either the verdict or the sentence - possible for the state to ask for the sentence to be reviewed
