the four main types of ADR are:
negotiation
mediation
conciliation
arbitration
advantages of less formal ADR (conciliationmediationnegotiation)
they keep the parties on good terms this means that businesses may still be able to work together families remain on speaking terms and neighbours learn to live with each other
mediation and conciliation in particular seek to preserve the relationship between the parties and negotiation can be a very quick way of achieving this
they are much cheaper than going to court
decision can be made in the best interest of both parties
disadvantages of less formal ADR (mediation,conciliationandnegotiation)
mediation and conciliation can only be used if the parties are on speaking terms
if mediation conciliation and negotiation does not work the parties will still need to go to court to settle the dispute
mediation is only effective if the mediator is skilled at their job
