  • Contract law is a legal area that governs agreements creating obligations between parties. It ensures that these agreements are honored and defines the legal consequences if a party fails to meet their obligations. In essence, it's the legal framework that upholds the sanctity of promises and ensures fair dealings in various transactions.
  • Damages
    Money awarded to compensate the plaintiff for losses caused by the breach
  • When a contract is breached, the non-breaching party (plaintiff) can seek remedies to make them "whole" again
  • Specific performance
    Remedy that forces the breaching party to fulfill their obligations under the contract, if possible
  • Rescission

  • In addition to defining what constitutes a valid contract, contract law also sets out rules governing the formation of contracts, including requirements like capacity (the ability to enter into a legally binding agreement) and consideration (something of value exchanged for a promise).
  • There are several types of contracts recognized by law, including express contracts (where both parties explicitly agree on terms), implied contracts (where there is no written agreement but actions indicate intent), unilateral contracts (one party offers something in exchange for certain conditions being met), and bilateral contracts (both parties promise to do something).
  • The main purpose of contract law is to ensure that people can rely on the promises they make to one another. This means that when someone makes an offer, the other person has the right to accept or reject it without fear of being misled or deceived. The law also provides remedies for breach of contract, such as damages or specific performance, which aim to put the non-breaching party back into the position they would have been in had the contract been performed properly.
