• pro - cheaper and quicker than going to court
• pro - arbitration is private - businesses might not want for their disputes to go public - scott v avery - protects future business relationships
• pro - an arbitrator can be chosen for their expertise in a particular area of dispute
• pro - the arbitrator will be chosen by the parties and they will also decide how the dispute will be heard at a convenient date for both parties
• con - no legal aid
• con - cases might involve a legal issue that an arbitrator cannot decide how to deal with it
• con - can be expensive and time consuming if the parties arent willing to talk to eachother
• con - arbitration might not work and so might end up in court - timely - court might not make the same decision the arbitrator did
