  • s.1(1) Criminal Attempts Act 1981:

    ‘If, with intent to commit an offence to which this section applies, a person does an act which is more than merely preparatory to the commission of the offence, he is guilty of attempting to commit the offence.’
  • AR: doing an act that is more than merely preparatory
    Gullifer test: ‘more than merely preparatory’ means D has ‘embarked upon the crime proper’ (meaning the point of no return – e.g. in White, D had put the poison in his mum’s drink)
  • MR: Intention to commit the full offence
    Whybrow – even though intent to do GBH was sufficient for the full offence of murder, only intent to kill
    will suffice for attempted murder
