Duration of offer, information or counter offer

• Law can be confusing

  • can be confusing on what actually amounts to an offer and how long it can stay open
• Counter offers

  • can terminate an original offer, but there if confusion about when there is a counter offer and when it is just a request for information as seen is the case of Harvey v Facey
• Time constraints

  • law states that even if the offerror sets a time until the offer will be open, they can change their mind before them
  • if a time has not been set, then the courts determine what would be reasonable,
  • this can lead to confusion as reasonable time is determined according to the circumstances in the case
