  • In what type of cases can CFAs be used in?
    All civil cases except family cases and can't be used in criminal cases.
  • What are many CFAs on the basis of?
    If the case is lost, the client pays nothing, but some solicitors charge a lower-level fee, even if the case is lost. The agreement also sets out the solicitor's success fee if the case is won.
  • What happens if the case in a CFA is won?
    The client has to pay the solicitor's normal fee and the success fee.
  • What % of the solicitor's normal fee could the success fee be?
    Up to 100%, but there is a cap on the success fee in compensation, which protects the client paying more than they won.
  • What can't a winning claimant do in a CFA?
    Claim the success fee back from the losing defendant.
  • What do clients of CFAs usually have to do regarding the other side?
    Pay the other side's cost which can be protected by 'after-the-event' insurance.
