• Mental Capacity Act 2005:

  • S1: above 16 years of age, refutably presumed to have capacity
  • S2: unable to give consent/make a decision if disturbance to mind/brain involved
  • S3: unable if the person cannot understand relevant information, retain or weigh them to make a decision.
