  • Test for voluntariness: test to see if confession was given voluntarily and free of any coercion.
  • Different factors or conditions the courts will examine in determining whether a confession was voluntary include:
    • if they get a break
    • if they are coerced
    • if they have eaten
    • lighting
    • if they have been able to ret
  • Warned statement (caution): A statement that is intended to give notice of the consequences of a promise. read after you read them their s. 10
  • R. v. Oickle: guides courts when considering confessions
  • person in authority might be officer, crown prosecutor, sheriffs, judge, guard, etc.
  • saying or acknowledging something qualifies as an admission of guilt. can be verbal or non verbal.
  • Conscriptive evidence: evidence that is forced out of someone by use of inducements, coercion. obtained as a result of violating their rights.
