  • Foster care
    A system in which a minor has been placed into a group home (residential child care community, treatment center, etc.) or private home or state certified caregiver, referred to as "foster parent" or with family member approved by the state
  • Children who may be placed in foster care
    • A child who is abandoned, surrendered, neglected, dependent, or orphaned
    • A child who is a victim of sexual, physical, or any other form of abuse or exploitation
    • A child with special needs
    • A child whose family members are temporarily or permanently unable or unwilling to provide the child with adequate care
    • A child awaiting adoptive placement and who would have to be prepared for family life
    • A child who needs long-term care and close family ties but who cannot be placed for domestic adoption
    • A child whose adoption has been disrupted
    • A child who is under socially difficult circumstances such as, but not limited to, a street child, a child in armed conflict or a victim of child labor or trafficking
    • A child who committed a minor offense but is released on recognizance, or who is in custody supervision or whose case is dismissed
    • A child who is in nood of special protection as assessed by a social worker,an agency or the DSWD
  • Qualifications to be a Foster Parent
    • Must be of legal age
    • Must be at least sixteen(16)years older than the child unless the foster parent is a relative
    • Must have a genuine interest, capacity and commitment in parenting and is able to provide a familial atmosphere for the child
    • Must have a healthy and harmonious relationship with each family member living with him or her
    • Must be of good moral character
    • Must be physically and mentally capable and emotionally mature
    • Must have sufficient resources to be able to provide for the family's needs
    • Must be willing to further hone or be trained on knowledge, attitudes and skills in caring for a child
    • Must not already have the maximum number of children under his foster care at the time of application or award, as may be provided in the implementing rules and regulations(IRR) of this Act
    • An alien possessing the above qualifications and who has resided in the Philippines for at least twelve(12)continuous months and maintains such residence until the termination of placement by the DSWD or expiration of the foster family license, may qualify as a foster parent
  • A foster parent may adopt his foster child subject to certain conditions
  • Save the Children advocated the passage of Republic Act 10821 or the Children's Emergency Relief and Protection Act that directs national and local government agencies to implement and sustain comprehensive emergency program to protect children from disasters and emergencies

    • Every child is endowed with the dignity and worth of a human being from the moment of his conception, as generally accepted in medical parlance,and has,therefore,the right to be born well
    • Every child has the right to a wholesome family life that will provide him with love, care and understanding, guidance and counseling, and moral and material security. The dependent or abandoned child shall be provided with the nearest substitute for a home
    • Every child has the right to a well-rounded development of his personality to the end that he may become a happy, useful and active member of society
    • Every child has the right to a balanced diet, adequate clothing, sufficient shelter, proper medical attention, and all the basic physical requirements of a healthy and vigorous life
    • Every child has the right to be brought up in an atmosphere of morality and rectitude for the enrichment and the strengthening of his character
    • Every child has the right to an education commensurate with his abilities and to the development of his skills for the improvement of his capacity for service to himself and to his fellowmen
    • Every child has the right to full opportunities for safe and wholesome recreation and activities, individual as well as social, for the wholesome use of his leisure hours
    • Every child has the right to protection against exploitation, improper influences, hazards, and other conditions or circumstances prejudicial to his physical, mental, emotional, social and moral development
    • Every child has the right to live in a community and a society that can offer him an environment free from pernicious influences and conducive to the promotion of his health and the cultivation of his desirable traits and attributes
    • Every child has the right to the care, assistance, and protection of the State, particularly when his parents or guardians fail or are unable to provide him with his fundamental needs for growth, development, and improvement
    • Every child has the right to an efficient and honest government that will deepen his faith in democracy and inspire him with the morality of the constituted authorities both in their public and private lives

  • Responsibilities of the Child
    • Strive to lead an upright and virtuous life in accordance with the tenets of his religion, the teachings of his elders and mentors, and the biddings of a clean conscience
    • Love, respect and obey his parents, and cooperate with them in the strengthening of the family
    • Extend to his brothers and sisters his love, thoughtfulness, and helpfulness, and endeavor with them to keep the family harmonious and united
    • Exert his utmost to develop his potentialities for service, particularly by undergoing a formal education suited to his abilities, in order that he may become an asset to himself and to society
    • Respect not only his elders but also the customs and traditions of our people, the memory of our heroes, the duly constituted authorities, the laws of our country, and the principles and institutions of democracy
    • Participate actively in civic affairs and in the promotion of the general welfare, always bearing in mind that it is the youth who will eventually be called upon to discharge the responsibility of leadership in shaping the nation's future
