  • The usc was created through the constitution however the uksc was created via the constitutional reform act (2005)
  • Both the UKSC and the USC are the final courts of appeal, however there is an exception in the UK as in human rights cases the European Court of Human Rights is the final court of appeal because of the Human Rights act 1998
  • Both supreme courts have the power of judicial review however the USC's power to do this is much stronger because in the UK judicial review only applies to government actions. This review can also technically be ignored if the government has a parliamentary majority
  • Both the USC and the UKC are responsible for protecting civil rights. The USC can strike down laws that infringe the Bill of Rights and the UK can identify a law as being incompatible with the HRA 1998, however Parliament can ignore thus.
  • USC judges are nominated by the president and then confirmed by the senate. UKC justices are selected by an independent selection commission before being presented to the Lord chancellor for approval.
