  • Original Precedent
    when a point of law has never been decided before. Once the judge has made a decision this then becomes precedent for future cases.
  • Binding Precedent

    precedent from a previous case in a senior court that must be followed in later cases if the facts or point of law is sufficiently similar.
  • Persuasive Precedent
    judgement that should be followed in similar cases, but is not binding.
