    lower courts are bound by the higher Courts, even the COA is bound by its own decisions so past decisions makes the law very rigid
  • Complex
    Due to the number of cases heard, it is difficult to find the law in one place. Judgments are too long and complex that it is sometimes hard to identify the ratio in the case.
  • Slow Growth
    judges know that some areas of the law need development or reform, the development of precedent depends on 
  • Not a democratic source of law
    unelected judges are making law by developing key legal principles
