Cards (24)

  • A strength of the judiciary is that they ensure fairness is kept throughout due to them following the model of the due process from this they focus on the rights of the offender and ensure all procedures have been carried out correctly
  • A second strength of the judiciary is that they are objective and not biased due to them being an independent organisation this is because we are separate from the politics so from these political views cannot be used or considered for any cases
  • A weakness of the judiciary is that that I claimed of them giving out and due sentences from this there isn’t understanding that the judges are being too soft and criminals and their punishment is not proportionate to the severity of the crime
  • A second weakness of the judiciary is up a lot of criminals get away with less punishment than a appropriate. This is supported as in 2016 141 prison sentences were increased by undily lenient sentence scheme was increased by 17% in 2015 however although it isn’t that many casee in a bigger picture. It did apply to most serious crimes such as trafficking rip and murder cases receiving lenient sentences
  • Lastly the judiciary are also accused of bias due to their being narrowing a backgrounds such as 71% of judges being male from this they may not understand individual cases such as sexual assault cases and what the impact it has on a female they typically blame the type of clothing but also social backgrounds and narrow and privileged
  • I strength for prison is that it focuses on the rehabilitation of offenders. This is a strength as they tried to modify their behaviour so they can be viewed as being a more socially acceptable to re-enter into society.
  • A second strength of prisons is that it provides public protection for society but also for the offenders family and friends from this their freedom is taken away and society can continue with normality without the worry of harm being caused
  • A weakness of prisons however is that there is a long-term issue of drug misuse of smuggling from this there is a new rise of the NPS drug spice from 2013 to 2016. This led to 64 deaths. This is also also a weakness as those who are taking these drugs become less engage with the programs provided and no longer want to modify their behaviour.
  • A second weakness of prisons is that there is a big issue surrounding overcrowding this is because from 1993 to 2019. The number of inmates have nearly doubled we nervous as numbers have gone from 43,000 to 82,000 this is for weakness as at least two deteriorating conditions violent and aggressive behaviour increasing as well as it been hard to maintain order throughout.
  • There is also a significant risk around safety of the prisons. This was because in 2018 there was around 8400 tax on staff and around 22,000 attacks and prisoners.
  • As strength of the prison reform trust is that it works to highlight poor conditions and overcrowded human rights violations this is a strength as they are to create better conditions which could lead to crime rates being decreased
  • A second strength of the prison reform trust is that it is non-governmental funded or owned due to being an independent organisation. From this there is no political views or bias being involved however the funding becomes a weakness.
  • A weakness of the prison reform trust is the funding this is because it can lead to financial constraints due to them relying heavily on donations
  • A second weakness is that no drastic changes have been made to prison this is because there is still overcrowding as well as crime rates increasing inside
  • A strength of women’s aid is that it is successful in supporting survivors this is because they’ve been able to provide support and advise online and in person for those who are risk of harm
  • A second strength is that they are able to help women and children I signs of domestic abuse and where they can get support from
  • A weakness however of the women’s aid is that it is a non-government funded or organisation From this, they can be limited to what they can support these individuals due to heavily on donations
  • A strength of the police is that they could bring justice to victims and family due to the evidence and statements collected to support case however not all cases receive a successful outcome this is because not enough evidence and research has been gathered to build up a case by the police so this is declined by the CPS
  • A second strength of the police is that they always abide the police code of ethics and tend to be impartial to the law. However there has been allegations been made about racism in the police force. This is because black and Asian males and nine times more likely to be stopped and search and white males.
  • A strength of the police force is that they aim to provide safety for their working practices to a community however some police officers are known to use their powers e.g. through sexual misconduct this is an example of the Sarah Everard case in which she was a victim of sexual misconduct by police officer wayne cousins
  • Due to the 19% funding drop from 2010 to 2018 they lost around 20,000 officers from this new offices have very little experiences
  • Strengths of the CPS

    • They carry out a full code test to all cases
    • This gives a standard and fair approach to decision making
    • It reduces the risks of biased views and subjectivity due to the individual or type of crime committed
    • In 2018, 84.1% of defendants were convicted, showing the strength of the CPS work and how effective they are to pass a case which has enough evidence to prove someone guilty
  • Weaknesses of the CPS
    • They have been criticised for being too close to the police
    • This leads to questions of objectivity and bias views on cases because the police have more information and knowledge on an offender than the CPS due to previous dealings with them
    • They have been criticised for being too slow and poor at communicating
    • This prolongs the stress for victims and defendants, and the CPS can also lose evidence through witness statements which causes the case to lose stability
  • The CPS aims to achieve social control
