  • Limitation to probation achieving social control is the repeating offenders. This is because if offenders failed to rehabilitate themselves and continue to commit crime level of social control will never be achieved. It can also cause on probation as recividim rates I’m ready. Calls to prison have increased over recent years. This is because of 50% of those convicted returns to prison within the year.
  • Environment is also a limitation to probation. This is because when prisoners are released on license they are released back to their home environment from this. The environment can have a significant impact of mother they stay in and out of prison. They are also not able to achieve social control due their being limited opportunities in their previous environment, this is because they are going back to previous causes of crime such as friends, neighbourhood, poverty etc
  • Finance also becomes limitation to probation in achieving social control. This is due to the funding being limited across agencies with budget and staff being cut over the years from this there will not be an adequate amount of support for those who need it when on licence or community payback
  • Access to resources and supporting prisons are limitation as we short sentences there is not enough time for a prisoner again any training or suitable access to education or drug programs from this there is a lack of support to help individuals avoid crime in future situations
  • A limitation of support is also due to lack of resources for training. This was stated in the 2018 report on prisons by the chief inspector. He found that 50% of prisons were failing to provide inmates with useful and meaningful activity each day from this they were being locked up most of the day with no sign of socialisation or outdoor activity which they are entitled to by human rights legislation.
  • However there is also lack of support of resources outside the prisons this is because when offenders are released from prison only a quarter of them have a job to go to from this lack of them struggle to survive on the outside world which makes them more prone to crime again. There are also statements around offenders being released on a Friday
  • There is statements around offenders being released on a Friday. This is because many releases take place on a Friday in which becomes problematic. This is due. They’re not not been enough time for them to sort out things such as medication accommodation and even income and funds before the weekend shut down meaning a lack of support and resources.
  • There is a campaign for lack of resources and support set up called end Friday releases and this is a campaign to try end this practice. This is because it leaves many offenders homeless in which they turned to crime for a survival.
  • Limitations of the CPS achieving social control is that there is limited funding due to the budget and staff cut from 2010 to 2018. From this it impacts effectiveness of level of social control achieved this is because there is a strain on staff and time for investigate crimes cases thoroughly.
  • For CPS achieving social control a lot of them are being moved to the magistrates court, which lacks control
  • Civil liberties illegal barriers can also be limitation of the CPS achieving control. This is because an individual has basic rights and freedoms which are granted to them by the country from this the CPS must remain objective through their full cause test and not create a pre conscious bias on a case. CPS can also not prosecute if there is no law against what a person has done
  • Limitation of civil liberties on the CPS is that some religions and countries have different freedoms
  • Repeat offenders can also have a limitation on achieving social control for the CPS as overtime. They become well known to a CPS which leads their investigation to be subjective. This is because even though their previous behaviour may not relate to the current crime they may use that information and knowledge when investigating a case using the full test overall there is a failure to produce successful prosecution at test to prosecute can be hard to follow times
  • Overall limitation for the CPS achieving social control is that the CPS cannot control their social factors that cause offending
  • Civil liberties become a limitation for the judiciary to achieve social control. This is because some of the legal barriers limit the control as a justice system focuses on uphold the civil liberties of offenders potential suspects. From this it is favoured from the due process model.
  • Limitation of legal barriers and civil liberties for judiciary is that there are too many barriers and justice can become delayed. This is because there are too many procedures which have followed in the due process model hence why it is described as an obstacle course that is also a limit of social control as a due restricted from departing foreign nationals who have criminal records Eg deportation of terroists.
  • There are of all difficulties with balance in the civil liberties with the judiciary. This is because their restrictions to departing them even though they are risk to nation security this may be due to their prison systems being more dangerous in their country compared to the UK.
  • Local and national policies can also be limitation to the judiciary as there can be a lot of focus on certain crimes from this. There is assumptions that sentencing becomes a lot harsher for example of London rights in 2011 in which sentencing was increased by 25% of all control becomes out of hand as there is less priorities on other serious crime
  • the judiciary are also limited by lack of resources and support outside of prison for example resividism rates. The judiciary cannot control this.
  • limitation to probation achieving social control is the repeating offenders this is because if offenders fail To rehabilitate themselves and continue to commit crime the level of social control will not be achieved as well as this. It is caused a strain on probation as reoffending rates and recalls to prison have increased over recent years. This is because of 50% of those convicted return to prison within a year.
  • Environment is limitation to probation this is because when prisoners are released on license they are released back to their home environment from this. Their environment can have a significant impact on whether they stay in and out of prison. They are also not able to achieve so social control due to the limited opportunities in their previous environment this is because they are going back to previous causes of crime such as family friends and poverty.
