s20 GBH

• • Malicious wounding or inflicting grievous bodily harm
• This offence is provided under s20 of the Offence Against the Person Act 1861
• This is also a statutory offence and is also a TEW offence that has a fixed term sentence of 5 years
• the actus reus of this offence is: unlawfully wounding or unlawfully inflicting GBH.
• If a wound state:

  Eisenhower provides a wound is any injury that breaks both layers of the skin.
• If GBH, state:

  Smith provides GBH is really serious harm and Saunders provides it is serious harm
• Brown and Stratton: A collection of ABH injuries may become GBH
• Bollom: ABH injuries on a vulnerable victim (a baby, an old person etc) can become GBH
• Burstow: serious psychiatric injury can be sufficient for GBH
• Dica: a disease can be GBH
• The mens rea of this offence is: intention or recklessness as to inflicting some injury, as outlined in Parmenter/savage.
