  • Charter of Rights and Freedoms: The Canadian Charter of Rights and Freedoms promotes fundamental rights such as life, liberty and personal safety and that they cannot be easily overturned. It promotes individual rights as long as they do not infringe on the rights of others 
  • Charter of Rights and Freedoms: The Canadian Charter focuses almost exclusively on individual rights, possible at the expense of the rights of the community 
  • In some countries labeled as dictatorships or totalitarian states, individual rights and freedoms have been subjected to the needs of the state, even if they have a constitution or other document about rights and freedoms
  • Minority Rights: A society includes minorities of different kinds, and these minorities are inclined to believe that constitutions and charters exist not only to protect individuals against the unfettered power of the state, but also to protect minorities against the domination or negligence of the majority

  • Protection of Minority Rights vs Individual Rights: Classical Liberals: Implementation of collective rights would go against the ideals of individualism. They believe that all individuals are equal in a liberal society and that collective rights violates that equality
  • Protection of Minority Rights vs Individual Rights: Modern Liberals: See the need to help minorities compete and protect their culture through the implementation of collective rights. They are necessary for minority groups to become equal to the majority and they need these rights to protect their culture.
