Breach of Contract

• There are two types of breach: actual and anticipated.
• Pilbrow v Pearless de Rougemont: Actual breach
• Poussard v Spiers & Pond: Breach of condition. Entitlement to repudiate and to claim damages.
• Bettini v Gye: Breach of Warranty
• Hochester v De La Tour: Anticipatory breach
• Repudiatory breach: A party makes it clear that they no longer intend to be bound by the contract.
