Priority

• Priority can be viewed as a queue, with interests 'taking priority' over other interests.

  • Where this happens, the interests that take priority will be binding.
• Where this may get complex is the discussion on interests that take priority in the course of registered disposition e.g. a conveyance.

  • If a new purchaser takes ownership of title, which interests will they be bound by? Which interests will take priority?
  • If the list of interests is simply temporal, all interests which came before the registered disposition will take priority.
