• Breach

  Defendant has in some way failed to observe a law or obligation imposed on them.

  Plaintiff has the responsibility and needs to establish that the defendant is in breach.
• Causation

  The actions of the defendant caused or resulted in the harm suffered by the plaintiff and harm would not have occured if not for the actions of the defendant.
• Loss

  A plaintiff can only obtain a legal remedy if it can be proved there was loss or harm.
