  Negligence = 6 years
• Calculation of time

  • General negligence - starts date that plaintiff suffered loss/damage
  • Disease or disorder - starts date on which person first knows about it
  • Death or personal injury claims
  • 12 years from date of conduct which caused death/injury
  • 3 years from date of which cause of action was ‘discoverable’
• Child Abuse

  Legislation since 2015 now removes limitation periods in respect of child abuse to allow survivors to bring a civil action regardless of time that has passed since act occurred.
