OBLIQUE INTENTION

Cards (2)

  • Oblique intention is when it isn't the defendant's aim to bring about a prohibited result, but he foresees the result as virtually certain to occur as a result of his actions
  • R v WOOLIN (1998) - The defendant lost his temper and threw his 3 month old baby towards his pram which was next to a wall. The baby suffered head injuries when he hit the wall and died. The court ruled that the consequence must be a virtual certainty and the defendant must realise this.
