ADVANTAGES

• Using a method of ADR is less formal than using the courts - parties can solve issues themselves
• Lawyers are not encouraged as:

  • process is flexible and less formal
  • there is no rule that the loser pays the winner's costs which means it is likely for the costs of parties to be lower and there will be no winner/loser situation
• It is quicker and easier than going to courts. If there is a hearing, it is likely to be in private and there will be little or no publicity to embarrass the parties
• In negotiation, conciliation and mediation the decision doesn't have to be strictly legal and is more likely to be based on commercial common sense and compromise.
