  • What is the Robinson test?
    It asks that a duty should be identified through precedent, and existing statutes and as such should be identified through analogy. Where there is an existing or analogous duty that canbe applied, the courts do not need to consider the Caparo test, as such consideration has already been determined, recognising the duty.
