independent contractors

• s2(4)(b) occupier can avoid liability for injuries/damage suffered by C when caused by negligence of independent contractor
• occupier must prove 3 things
• 1. must have been reasonable for occupier to have entrusted their work to an independent contractor (haseldine v daw & son)
• 2. contractor hired must be competent to carry out the task (bottomley v todmorden cricket club)
• 3. if possible occupier must inspect the work (woodward v major of hastings)
