  • Advantages of controls of DL (Same as reasons for DL)
    P- Time
    DEV- This gives Parliament more time to deal with more urgent issues. This ensures that laws are introduced more efficiently
    • e.g. national covid strategies leaving local strategies to local councils
    E- However, some important issues are passed through DL rather than in Parliament meaning it could lead to unfair laws
  • Advantages of controls of DL
    P- Emergency speed

    DEV- Parliament can take months to introduce new law where DL (especially orders in council and statutory instruments) allows laws to be passed in matter of hours or days
    • e.g. Order in council freezing bank accounts of suspect terrorists in 48 hours after 9/11
    E- However, rushed laws can lead to poor decision making in laws.
  • Advantages of controls of DL
    P- Future needs

    DEV- Acts of Parliament can be future proofed by allowing a process to amend them through statutory instrument. This enables law changes without the long process
    • e.g. Dangerous Dogs Act 1991 - allows more breeds to be added on
    E- However, this can lead to laws being made that aren't fully thought through by relying on future amendments.
  • Disadvantage of controls of DL (ONLY DIFFERENCE FOR CONTROLS)
    P- Undemocratic

    DEV- Parliament pass down power to other bodies meaning MPS are no longer in charge.

    E- However local councils are elected are elected so there's still controls in place
  • Disadvantage of controls of DL (ONLY DIFFERENCE FOR CONTROLS)
    P- Lack of publicity

    DEV- When these laws are passed the public aren't aware of the changes this goes against the rule of law.

    E-However, DL is often published in government journals to ensure that those who need to know about new law can access information

    P- Hard to keep track

    DEV- Over 3000 statutory instruments are passed each year meaning about 10 per day. Hard to keep track of all the changes which can lead to confusion and mistakes

    E- However statutory instruments have systems to ensure that they are monitored
