  • why non custodial sentences are ineffective - tags can easily be broken
The offender may serve their sentence but at home under certain curfew conditions. An electronic bracelet is secured around the offender’s ankle to monitor and restrict their movements and activities. In 2018-19, one quarter of offenders freed on home release in Scotland were jailed again for breaching their tagging rule
  • why non custodial sentences are ineffective - seen as a soft option
This means that even though alternatives such as a CPO order the offender to carry out up to 300 hours of community service and provide a form of ‘pay back’ to a community they might have damaged, they still have lots of freedom leaves offenders free to commit more crimes. For example, almost one third of offenders in Scotland did not complete their CPO in 2019-20
  • why non custodial sentences are ineffective - doesn’t offer protection
This means that if an offender is sentenced to time in prison this protects society and keeps communities safe as they are no longer able to commit crime. This is NOT the case with non-custodial sentences. For example, if someone commits a crime, the community may be safer when the offender is no longer free to pose a threat. A non-custodial sentence might still give them the freedom to re-offend.SQA Exam
