  • 1.volume of delegated legislation - difficult to control

    not all of it can be given proper scrutiny - before coming into force
    much of it is passed without proper checks

    very difficult to remove a piece of legislation - once it has come into force

    made in a very technical way - those scrutinising it will often not have the sufficient knowledge of / expertise - in the relevant law

    to access whether is has been validly made
  • 3.scrunting committees lack of power

    can only make recommendations to parliament - may or may not choose to act on those recommendations

    no power to alter the regulations - stop them from becoming law
    often referred to as ' watchdogs with no teeth'
  • 4.the affirmative revolution is rarely use + lengthy

    when used there will be debate in parliament - important and potentially controversial matters

    time consuming and relies on time being allocated - for debate
    dispute on the issue - government will win - majority in the house
  • 5.the negative resolution process is limited

    as most SI's use negative resolution procedure - too many - only some will be looked at in detail

    considered to have a limited effect - no strict requirements to look at SI's - under this procedure

    legislation made this wat is not challenged and automatically becomes law - after 40 days
