  • S.76 Controlling and Coercive (Serious Crime Act 2015)
    A person commits an offence of coercive or controlling behaviour if
    • repeatedly or continuously engages in behaviour towards another person that is controlling or coercive
    • at the time of the behaviour, they are personally connected
    • behaviour has a serious effect on victim
    • know or ought to know that the behaviour will have a serious effect on the victim
  • Controlling behaviour
    • isolating victim from sources of support
    • depriving them of means needed for independence
    • regulating everyday behaviour
  • Coercive behaviour
    • act or pattern of acts or assaults, threat, humiliation and intimidation or other abuse that is used to harm, punish or frighten the victim
  • Serious effect
    • if it causes someone to fear on at least 2 occasions that violence will be used
    • or causes another person serious alarm or distress which has substantial adverse effect on their day to day activities

  • Risk levels - Standard :
    • appears to be no pattern of abusive behaviour or control
    • currently doesn’t indicate likelihood of causing serious harm
  • Risk levels - medium
    • appears to be a pattern of abusive behaviour of control and/or frequent physical violence
    • offender has potential to cause serious harm but unlikely unless there is a change of circumstances
  • Risk levels - high
    • extreme level of control and very frequent and severe physical violence
    • serious threat of harm posed to victim
  • Risk levels - serious
    • life threatening risk
  • DVPO/DVPN
    • aims to provide victim with a degree of safety following immediate aftermath of a DA incident
    • notice issued by Supt for up to 48 hours
    • order can last up to 28 days
    • DVPO issued by the court
    • DVPN issued by police
  • Domestic violence disclosure scheme (DVDS)
    • allows a person to make an enquiry to police to disclose relevant information about someone
