    • if a seatbelt is fitted it must be worn
    • children up to 12yrs or up to 1.35m must have a proper child restraint

    A person driving an MPV on a road or riding a cycle must stop on being requested to do so by a Constable in uniform or a traffic officer

  • S.164 RTA 1988
    A person must on being required by a PC produce their driving licence when:
    • driving a MV on a road supervising a provisional learner
    • driver of a MV at the time of an RTC
    • a person who has committed an offence in relation to the use of a MV
  • S.165 RTA
    A Constable can require a person to produce insurance document and MOT certificate when
    • a person is driving an MV on a road
    • a person believed to be the driver at the time of an RTC
    • a person believed to have committed an offence
  • S.165a RTA
    • a police Constable can seize a vehicle for no insurance or licence
    • they must issue a VSN to the driver at the time
    • if the driver is not the owner, they must issue a VSL and VSN to the owner

    • S.19 PACE
    • prevents a vehicle being concealed, lost, altered, damaged, destroyed
  • S.67 RTA
    • Allows an authorised examiner to test a MV on a road for the purpose of ascertaining whether the following requirements comply:
    • construction and use requirements
    • that the vehicle is not such that its use on a road would involve a danger or injure a person
  • S.40a RTA
    • when a person uses, cause or permits another to use a MV or trailer on a road when:
    • the condition of a MV or accessories/equipment
    • or purpose it is used for

    • or weight, position or distribution of its load or how it is secured

  • S.42 RTA
    A person who fails to comply with any construction or use requirement other than one within:
    • 41a - brakes
    • 41b - overweight
    • 41d - mobile phone/ proper control
    • or uses a MV on a road which does not comply with such requirement, causes or permits a MV/trailer to be used
    • is guilty of an offence
  • S.103 Driving whilst disqualified RTA
    A person is guilty if holding or obtaining a licence is disqualified, and drives a MV on a road
  • 3 types of disqualification
    • obligatory disqualification - required by law
    • discretionary disqualification - decided by courts

  • S.2 RTA Dangerous driving
    A person who drives a MPV dangerously on a road or other public place is guilty of an offence
  • S.3 RTA Careless/inconsiderate driving
    A person who drives a MPV on a road or other public place without due care and attention, or without reasonable consideration for others is guilty of an offence
  • Traffic offence report (TOR)
    • done at the roadside
    • sent to DDT to decide next course of action
  • Notice of intended prosecution (NIP)
    • purpose is
    • to make driver aware of the offence they committed
    • make them aware they may be prosecuted
    • give them time to prepare a defence

    • D - dangerous, careless or inconsiderate driving
    • A - aiding and abetting any of these offences
    • F - failing to conform to a direction given by an officer
    • F - failing to conform to traffic signs
    • L - leaving a vehicle in a dangerous position
    • E - exceeding the speed limit
  • S.41D RTA 1988
    It is an offence to
    • drive
    • supervise the driving of a L
    • cause or permit to be driven in a MV on a road if the driver is using:
    • a hand held mobile
    • a hand held device which performs an interactive communication function by transmitting and receiving data
  • S.59 Police Reform Act
    • relates to traffic related ASB
    • where a PC/PCSO in uniform has reasonable grounds to believe that a MV is being driven contrary to
    • S.3 RTA and/or S.34 RTA
    • and is likely to cause alarm, distress or annoyance to the public the Constable may:
    • order the person driving it to stop
    • seize and remove the MV
    • enter any premises to which there are reasonable grounds to believe the MV will be
    • use reasonable force in relation to any of these

  • S.22(a) RTA - Causing danger to Road Users
    An offence to intentionally and without lawful authority or reasonable cause:
    • cause anything to be on or over the road
    • to interfere with a MV, Trailer or cycle
    • to interfere with traffic equipment

    A person who when, driving, attempting to drive, is in charge of a MPV on a road or other public place and he is unfit to drive through drink or drugs is guilty of an offence
