  • s13- as to description

    -> goods must correspond to any description applied to them-> can include the way goods are packaged
  • s14 (2) - goods are of satisfactory quality 

    ->fit for purpose for which goods of the kind in question are commonly supplied
    ->appearance and finish -> safety and durability
    -> freedom from minor defects
    DOESNT APPLY IF
    • defects were brought to purchasers attentions before purchase
    • goods were examined before purchase and the defect should have been noticed by the purchaser
  • s14 (3) - goods must be fit for purpose

    ->where buyer has expressly made known to the seller the purpose for which the goods are being purchased
    ->applies regardless of whether the goods are commonly supplied for this purpose
    ->inserted into contract where buyer is relying on skill/expertise of seller
    -> no need to state purpose where goods are being used for their ordinary use
