Judicial neutrality

Cards (4)

  • Relative anonymity
Operate away from the public eye - judges rarely used to speak out publicly on issues of law or public policy
Still expected to avoid being drawn into open defence of their rulings
  • Restriction of political activity
Judges are not supposed to campaign on behalf of a political party or pressure group. Judges retain the right to vote, but their political views should not become a matter of public record
  • High level training
Highly trained profession regulated by the Law Society - experience required means they have demonstrated they are able to put personal bias aside
  • Legal justifications of judgements
Senior judges are expected to explain how their judgements are rooted in law - makes it less likely they will be guided by personal bias
