Evaluation of ADR

• Advantages - Keeps parties on good terms and preserves the relationship between the parties.
• Advantages - Commercial mediation may save businesses more than £1 billion every year (e.g. court fee)
• Advantages - Parties involved in the decision making, using common sense, rather than following the law.
• Advantages - Much cheaper & quicker than going to court
• Disadvantages - Mediation and conciliation can only be used if the parties are on speaking terms
• Disadvantages - Inappropriate to use mediation or conciliation in family dispute cases with allegations of abuse
• Disadvantages - There is no legal aid available for mediation and conciliation
• Disadvantages - If ADR doesn’t work, parties still have to go to court
