Due Process Model

• The due process model is supported by Left Realism so left wing political parties - labour; causes of crime over the individual.
• Lea and Young’s relative deprivation: deprived of what everyone else has, also supports the due process model.
• The form of deviant subcultures: deviant norms and values, also support the due process model.
• Another left realist theory of crime is marginalisation: pushed to the edges of society, society doesn’t care so they don’t care. This supports the due process model of crime.
• The due process model makes a point to protect individuals at all costs: limit power of the state; oppressor of accused; police powers.
• The due process model suggests offering rehabilitation or help to potential offenders and to educate them.
• Believe people are innocent until proven guilty.
• The due process believe that court cases should be slow and methodical.
• Due process believe police powers should be restricted: PACE.
• They argue a few criminals in society is a price worth paying for the protection of the rest of society.
• The emphasis is on the suspects / rights of the accused.
• The due process model aims to prevent crime.
