SC and HRA

Cards (2)

  • The HRA meant that citizens could pursue human rights cases under the ECHR in UK courts. It provided a double lock on rights, meaning there was a stronger protection of rights. It doesn't have the same legal status as EU law or the US Bill of Rights as it is only statute law and can be overturned by an act of parliament
  • HRA increased the powers of the UK Supreme Court as it broadened their jurisdiction to be able to issue a declaration of imcompatibility which the UK government is not legally required to act on but usually do due to pressure and convention
